IF YOU DO NOT AGREE WITH THE TERMS OF THIS AGREEMENT, YOU ARE NOT PERMITTED TO VIEW THE WEBSITE OR USE THE SERVICES.

Australianbizdirectory.com.au's Proprietary Rights and Permitted Use

The Website and the Services are the sole and exclusive property of Australianbizdirectory.com.au and/or its suppliers. You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purpose, any portion of the Website or Services, use of the Website or Services, or access to the Website or Services. Use of the Website or the Services in any way not expressly permitted by this Agreement is prohibited, and may be actionable under international law.

You agree that Australianbizdirectory.com.au shall not be liable to you or any third-party for any such suspension or termination.

You acknowledge that links to third-party sites are provided for your convenience. Such sites are not within our control and may not follow the same privacy, security, or accessibility standards as ours. Australianbizdirectory.com.au neither endorses nor guarantees offerings of the third party providers, nor is Australianbizdirectory.com.au responsible for the security, content or availability of third-party sites, their partners, or advertisers.

BY COMPLETING THE SERVICE REGISTRATION FORM AND CLICKING THE SUBMIT BUTTON, YOU REPRESENT AND WARRANT THAT YOU ARE 18 YEARS OF AGE OR OLDER, THAT YOU AGREE TO PROVIDE TRUE, ACCURATE, CURRENT AND COMPLETE INFORMATION, AND THAT YOU AGREE TO BE BOUND BY THIS AGREEMENT.

Australianbizdirectory.com.au reserves the right to decide whether, where, and how a site is listed. If Australianbizdirectory.com.au accepts your site, Australianbizdirectory.com.au reserves the right to list your site in any category or subcategory as Australianbizdirectory.com.au deems appropriate, in its sole discretion.

Australianbizdirectory.com.au reserves the right not to include any specific keywords in the title or description of your site. Australianbizdirectory.com.au also reserves the right, in its sole discretion, to remove your site from the Directory, move the listing to a different category or subcategory, and change or remove any keywords at any time, for any reason.

Australianbizdirectory.com.au strives to build, maintain, and promote a quality business directory and business search engine for business professionals and advertisers. Therefore, we DO NOT ACCEPT the following type of business or activities.

• Warez, illegal, Gambling, Pornography, Drugs/Pharmacy, Retail tobacco, Alcoholic drinks related, Multi-Level Marketing sites or inappropriate.
• When registering for membership users must enter their full name. Business names or first names only will not be accepted when registering for membership.
• Are related to narcotics, steroids, certain controlled substances.
• Websites submitted for listings must be up and running 24/7 and must not be under construction and must support multiple browsers and versions and must not contain broken links.
• Websites submitted for listings must display current business or owner contact details.
• Promote hate, violence, racial intolerance.
• Members must use their business domain registered email accounts or website email contact address when proposing a new listing. Gmail, Yahoo mail and hotmail will not be accepted. Except in extreme circumstances and allow for long delay for verifications.
• Infringe or violate any copyright, trademark, right of publicity or privacy.
• Registration is limited to one registration per person, business, club, association, organisation or interest group.
• Are related to firearms, firearm parts or accessories, ammunition, weapons or knives.
• Site with pop-up windows of any kind.
• Veneer, Redirects and/or Mirror web sites.
• Site created specifically for Adsense, Banners and Links exchanges.
• Affiliates, Members, My Space, clickbank etc. sites.
• Only one FREE standard listing per website domain name URL is permissible. And before you proceed, please check membership features to ascertain what features are available.
• Providing false or misleading information or incomplete information will result in a rejected listing submission and/or rejected membership application for example you cannot list your business URL in business address or description space.
• Only registered purchasers of Listing/Advertising Services shall have the right to multi-list, multi-feature, feature-list or use the banner display system or use ads according to package purchased.
• 'Get Rich Quickly' or 'Snake Oil' or 'How to play poker or gamble' sites.
• Coming Soon or not finished yet site.

To get your site listed in Australianbizdirectory.com.au, you must agree to the terms below:

• If your submission is accepted, payment is final and non-refundable.
• Title must be the official website or business name.
  • Do NOT include keywords/keyword phrases or anything else after the official business/company name.
  • Do NOT use ALL CAPITAL letters, punctuation or symbols.
  • Do NOT supply a long list of keywords or repeat keywords in the title/description.
• We reserve rights to modify/delete/change the title, description and category of your listing to suit our guidelines.
• We reserve the right to remove any content that does not conform to policy.
• By submitting information, you are granting us permission to publish the information you provided.
• Most submissions take at least 10 business days and occasionally may take up to a month to appear online.

Your listing will remain in the Australianbizdirectory.com.au as long as it:

• Remains actively hosted and you honour your monthly, quarterly and yearly payments.
• Contains content that is relevant to the directory in which it is listed.
• Does not violate our Terms of Use.

You can change/edit your listing anytime by login to your account, however this change will be moderated and we review your listing change. Final determination on whether the change is accepted or not is made at our sole discretion.

Refund Policy

Due to the type of the information and services being sold, we unfortunately cannot accept returns of articles, profiles or lists once they have been delivered. We cannot and do not warrant that the information available through this service is accurate, complete or updated but rather is provided to the user 'as is'.

Please be sure to read all available information about a service before you place your order.

Feedback

Australianbizdirectory.com.au will contact Applicant who payed for business listing by email describing whether the site has been accepted or rejected.

If Australianbizdirectory.com.au accepts a suggested site, Applicant is entitled to request reconsideration of the placement of the site, description fields, title, etc, at no additional charge by login to their account and edit their listing. Australianbizdirectory.com.au will again review the Applicant's site and will then notify Applicant of its final decision regarding the site. Once a site is included in the Australianbizdirectory.com.au, if Applicant makes any substantial changes to the site, Applicant must comply with Australianbizdirectory.com.au's standard change process to make any changes to the listing in the Directory.

Indemnity

THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER THIS AGREEMENT NOR ANY DOCUMENTATION FURNISHED UNDER IT IS INTENDED TO EXPRESS OR IMPLY ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF IMPLIED WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

AUSTRALIANBIZDIRECTORY.COM.AU, AND ITS PARENTS, SUBSIDIARIES, EMPLOYEES AND AGENTS, SHALL NOT BE LIABLE, UNDER ANY CIRCUMSTANCES, FOR ANY LOSS OF BUSINESS, PROFITS OR GOODWILL, LOSS OF USE OR DATA, INTERRUPTION OF BUSINESS, OR FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER, EVEN IF AUSTRALIANBIZDIRECTORY.COM.AU IS AWARE OF THE RISK OF SUCH DAMAGES, THAT RESULT IN ANY WAY FROM APPLICANT'S USE OF OR INABILITY TO USE THIS SERVICE, AUSTRALIANBIZDIRECTORY.COM.AU'S ACCEPTANCE OR REJECTION OF A SUGGESTED SITE, OR AUSTRALIANBIZDIRECTORY.COM.AU'S CONTINUED LISTING OF A SITE IN THE DIRECTORY.

THE INFORMATION, ASSURANCES AND OTHER REPRESENTATIONS ON BUSINESS LISTINGS PAGES (COLLECTIVELY THE "INFORMATION") HAVE BEEN PROVIDED BY THE ADVERTISERS (BUSINESS OWNERS OR AN EMPLOYEE WITHIN THE COMPANY) AND HAVE NOT BEEN VERIFIED BY AUSTRALIANBIZDIRECTORY.COM.AU. THE ADVERTISERS ARE SOLELY RESPONSIBLE FOR THE ACCURACY AND TRUTHFULNESS OF ALL SUCH INFORMATION INCLUDING WITHOUT LIMITATION INFORMATION PROVIDED CONCERNING ANY CERTIFICATIONS, SPECIALTIES, LICENSES OR THE LIKE AND ANY WARRANTIES, PRICING AND/OR DISCOUNTS. YOU SHOULD CONTACT THE ADVERTISER TO VERIFY THE INFORMATION CONTAINED IN EACH BUSINESS LISTING PAGE BEFORE RELYING ON IT. AUSTRALIANBIZDIRECTORY.COM.AU EXPRESSLY DISCLAIMS ANY AND ALL LIABILITY IN CONNECTION WITH THE INFORMATION CONTAINED IN BUSINESS LISTINGS PAGES AND ANY USE THEREOF OR RELIANCE THEREON.

AUSTRALIANBIZDIRECTORY.COM.AU IS NOT LIABLE FOR ANY DELAY OR FAILURE IN PERFORMANCE UNDER THE AGREEMENT RESULTING OR INDIRECTLY FROM ACTS OF GOD, TERRORISM, OR OTHER CAUSES BEYOND ITS REASONABLE CONTROL.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM AUSTRALIANBIZDIRECTORY.COM.AU OR THROUGH OR FROM THE WEBSITE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS OF USE. NEITHER AUSTRALIANBIZDIRECTORY.COM.AU NOR ANY OF ITS DATA OR CONTENT PROVIDERS SHALL BE LIABLE FOR ANY ERRORS OR DELAYS IN THE CONTENT, OR FOR ANY ACTIONS TAKEN IN RELIANCE THEREON.

AUSTRALIANBIZDIRECTORY.COM.AU'S LIABILITY TO APPLICANT SHALL NOT, FOR ANY REASON, EXCEED THE AMOUNT ACTUALLY PAID BY APPLICANT TO AUSTRALIANBIZDIRECTORY.COM.AU UNDER THIS AGREEMENT.

Applicant Privacy

Australianbizdirectory.com.au maintains information about Applicant on secure servers, including but not limited to Applicant's registration information. Applicant agrees that Australianbizdirectory.com.au may use such information in aggregate form for marketing or other promotional purposes. Applicant agrees that Australianbizdirectory.com.au may disclose such information in the good faith belief that such action is reasonably necessary: (a) to comply with the law or legal process; (b) to enforce this Agreement; or (c) to protect the rights or interests of Australianbizdirectory.com.au or others; provided, however, that nothing in this section shall impose a duty on Australianbizdirectory.com.au to make any such disclosures. Australianbizdirectory.com.au may contact Applicant regarding Australianbizdirectory.com.au business listing program using the Applicant's email address provided during the registration process (or as updated by Applicant). Such email messages may contain opportunities regarding special offers and new products from Australianbizdirectory.com.au advertisers.

Participation

You acknowledge that Australianbizdirectory.com.au does not provide professional advice, and you agree that you will not use the Website as a substitute for or supplement to advice from a qualified professional, whether they be a financial, legal or other professional.

You may receive a password and account designation upon completing the Website's registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify Australianbizdirectory.com.au of any unauthorized use of your password or account or any other breach of security, and (b) log out of your account at the end of each session.

If you wish to discontinue participation in the Australianbizdirectory.com.au business listing program, you must send a notice to admin@australianbizdirectory.com.au as set forth in the Section, "Notices," below. Please state that you wish to withdraw your site from Australianbizdirectory.com.au. Once Australianbizdirectory.com.au receives such notification from you, your participation in the Australianbizdirectory.com.au business listing program will cease and your listing will be removed. You agree that Australianbizdirectory.com.au will not be required to refund any portion of such fee.

Notices

Any notices or communications under the Agreement shall be by electronic mail or in writing and shall be deemed delivered upon receipt to the party to whom such communication is directed, at the addresses specified below. If to Australianbizdirectory.com.au, such notices shall be addressed to admin@australianbizdirectory.com.au , such notices shall be addressed to the electronic mailing address specified in Applicant's Service registration form, or such other address as either party may give the other by notice as provided in this Section. It is the Applicant's responsibility to provide an accurate address and to ensure that Australianbizdirectory.com.au is notified of any changes to Applicant's address as specified in this Section.

Communications with Third Parties

Your dealings or communications through the Website with any party other than Australianbizdirectory.com.au are solely between you and that third party. Under no circumstances will Australianbizdirectory.com.au be liable for any goods, services, resources or content available through such third party dealings or communications, or for any harm related thereto.

Notice of Claims for Copyright Infringement; Copyright Policy

Entire Agreement

This Agreement constitutes the entire agreement between the parties with respect to the Service and supersedes all previous proposals, both oral and written, representations, writings and all other communications between the parties with respect to such subject matter.
